    The panel cannot take into account the cards he should have got, only the cards he has been issued.
    Therefore they have to treat him as of good character.

    Referees can however,collectively decide what is dangerous and apply a standard.

    Looking through some of the YouTube videos about him, "Shoulder Boy" does appear to have built himself a well-earned reputation as a dirty little cheap shot artist.

    Yep, the man was a dirty b'stard... no doubt about that. But that was back in amateur days, without two dozen cameras watching from every angle. He got away with a lot of his foul deeds because it wasn't always seen. In those days, rucking was an actual thing, if you were caught on the wrong side of one, you got "reminded" about it, and if referees were missing stuff in the front row, the players sorted it out themselves.

    Attitudes have changed now. For example, Jerry Collins had a very dangerous tackle-breaking technique in which he stepped into tackles with a knee up - if the tackler went too low, he'd cop a knee in the noggin. He also had a tendency to make high, no-arms tackles like Farrell. In 2001 he played three tests - in those three, he was penalised several times for late, high, dangerous tackles. He also copped a YC for a high tackle, and was dead lucky not to get two more. Those incidents resulted in him being dropped from the NZ team for the entire 2002 season and he was told in no uncertain terms that if he didn't address these issues, his professional and international rugby career would be limited. Troy Flavell was even worse, and he had a temper problem as well, which is why he didn't play very many games for NZ (22 over 8 years). He was eventually dropped because they considered his constant foul play a liability.

    The issue with Farrell is that he has been doing the same things unabated for 12 years and almost 300 professional matches for Sarries, England and the B&I Lions. He has gotten away with high tackles, coat-hangers and shoulder charges for all that time, and no-one appears to have made him address these techniques.

    5 weeks. Bit generous in my book. It was as bad a challenge as you can see. 6 weeks is medium so they are saying it was below medium on the scale. The kid could have broken his jaw. He was actually concussed which is serious. There was no mitigating factors.

    no - it was high-end (10 weeks) and then reduced by standard mitigation (good record, remorse etc)

    As far as i know at the week end they got 3 weeks not 3 games....
    there is a lot of precedent for considering the number of games -- bans are shorter in the RWC where (again) a week may contain two games, and bans are longer (in weeks) in last week of the season - so that they extend to missing games the follwoing season
